Article 1 — The Seller
1.1 The website torrini1369.com (the "Site") is operated by Torrini 1369 s.r.l., with registered office at Piazza del Duomo 12/R, 50122 Florence, Italy — VAT no. IT 06111170483, Florence Companies Register (REA FI-601401), share capital €10,000.00 fully paid, certified email (PEC) torrini1369@pec.it (the "Maison" or the "Seller").
1.2 For any enquiry concerning an order or these Terms, the Client may contact the Maison at info@torrini1369.com or +39 055 2302401.
Article 2 — Definitions
2.1 "Client": the natural or legal person placing an order through the Site.
2.2 "Consumer": a Client who is a natural person acting for purposes outside any trade, business, craft or profession, within the meaning of the Italian Consumer Code (Legislative Decree no. 206 of 6 September 2005).
2.3 "Creation": any jewel offered on the Site, made to order by the Maison in the configuration selected by the Client.
2.4 "Terms": these Terms and Conditions of Sale, in the version in force on the date of the order.
Article 3 — Scope and acceptance
3.1 These Terms govern all sales concluded through the Site between the Maison and the Client.
3.2 The Terms are made available to the Client, in a form that can be consulted and printed, on every page of the Site and through a visible link in the cart and at checkout. Before proceeding to payment, the Client expressly confirms, by ticking a mandatory checkbox in the cart, that they have read and accepted the Terms and Conditions of Sale and that the Creation will be made in the configuration and size indicated by them. This confirmation is recorded together with the order. The Terms accepted are also referenced in the order confirmation email.
3.3 Sales to Clients purchasing in the course of a trade, business or profession (including any purchase for which a VAT number or a company invoice is requested) are governed by Article 15; the provisions reserved for Consumers do not apply to such purchases.
Article 4 — Creations made to order
4.1 No stock held. The Maison holds no Creations in stock. Each Creation is made individually, upon the Client's order, in the configuration and — where applicable — in the size or length selected by the Client, by the Maison's Florentine workshop.
4.2 Configuration. For each model, the Client selects the metal (18kt gold or 950/000 platinum) and the gemstones (rubies, sapphires, emeralds and/or diamonds, depending on the model) from the configurations indicated on the product page. Each model is made exclusively in the configurations offered, one by one, upon order.
4.3 Size and length. All Creations, with the exception of earrings, require the selection of a size or length, which constitutes a production specification: the Creation is made for the Client in the size indicated at the time of the order. Should the desired size not appear among those offered on the product page, the Client may request it by contacting the Maison before placing the order: where technically feasible, the Creation will be produced in the agreed size, documented in writing, which constitutes for all purposes an individual production specification. A size guide and a pre-purchase advisory service are available to assist the Client in choosing the correct size. The Client is invited to verify the selected size with the utmost care before ordering: once made, the Creation does not allow its size to be altered (see Article 13.2).
4.4 Complimentary engraving. A personal engraving is offered free of charge on all models, within the maximum length provided for each category: 10 characters for rings, 5 characters for earrings, bracelets, pendants and necklaces. The engraving finds its place within the craftsmanship of the piece, which is interrupted to accommodate it, as stated on the product page before purchase. The Maison reserves the right to decline, giving notice to the Client, engraving texts that are offensive, unlawful or infringe the rights of third parties; in such cases the Client may indicate an alternative text or forgo the engraving.
4.5 Images and artisanal character. The images on the Site illustrate a sample of the selected configuration. Each Creation is made entirely by hand and employs natural gemstones: the finished piece may present slight variations in the craftsmanship and in the characteristics of the stones, which attest to its artisanal authenticity and to the uniqueness of the material. Such variations, disclosed in these Terms and on each product page, do not constitute a lack of conformity (see Article 12).
Article 5 — Ordering procedure and conclusion of the contract
5.1 An order placed by the Client through the Site constitutes an offer to purchase, governed by these Terms.
5.2 The contract is concluded upon the Maison's sending of the order confirmation email, which sets out: the Creation ordered, its configuration, the size or length selected, any engraving text, the price inclusive of taxes, the estimated production time, the statement that dedicated production has commenced and — for Consumers — the notice concerning the right of withdrawal and its exclusion pursuant to Article 10.
5.3 The Client is responsible for the accuracy of the information provided at the time of the order, including size, configuration and engraving text, which are summarised before payment.
5.4 The Maison reserves the right not to accept an order, giving prompt notice to the Client, where: (a) the payment details cannot be verified or there is a reasonable suspicion of fraud; (b) delivery to the indicated destination is not possible or is not permitted under applicable law; (c) the material required to make the Creation becomes unavailable. In such cases, any amount already paid will be refunded in full using the same means of payment used by the Client.
5.5 If, after the conclusion of the contract, the making of the Creation proves impossible — owing to the unavailability of gemstones meeting the Maison's quality standards, or to unforeseeable circumstances or force majeure — the Maison will promptly inform the Client and, where possible, propose an alternative solution, such as a different selection of gemstone or a new production timeframe. Failing agreement, or should the making of the Creation remain impossible, the order will be cancelled and any amount paid will be refunded in full using the same means of payment, at no further cost to the Client.
5.6 Before production begins, the Maison and the Client may agree upon a refinement of the order specifications — such as the addition or modification of the engraving text, or the confirmation of a detail of the configuration or size — documented by the Client's written confirmation. In that case, the specifications so defined replace the original ones for all purposes of these Terms, and the production time runs in accordance with Article 8.1.
Article 6 — Prices
6.1 All prices displayed on the Site are expressed in euro (€) and are inclusive of applicable taxes.
6.2 For deliveries to the destinations indicated as "duties and taxes included" in the Shipping Policy, the displayed price is final: no duty, import tax or additional charge will be requested from the Client upon delivery. For all other destinations, any duties and import taxes are borne by the Client, as set out in the Shipping Policy.
6.3 The price applicable to the order is the price published on the Site at the time the order is placed.
6.4 In the event of a manifest error in the published price, recognisable as such in relation to the value of the Creation, the Maison reserves the right to cancel the order, giving prompt notice to the Client and refunding in full any amount paid.
Article 7 — Payment
7.1 Payment is due in full at the time of the order, through the methods made available at checkout: payment cards (Visa, Mastercard, American Express, Cartes Bancaires, Postepay), PayPal and bank transfer. In the case of payment by bank transfer, the order is deemed completed upon the Maison's receipt of the funds, from which moment the production time under Article 8.1 also begins to run.
7.2 Payments are processed through secure, certified payment service providers. The Maison does not store the Client's full payment card details.
Article 8 — Production times and delivery
8.1 Each Creation is made to order in approximately 45 working days, running from the order confirmation (or, in the event of a change of specifications agreed pursuant to Article 5.6, from the Client's written confirmation of the final specifications). Certain kinds of craftsmanship may require longer, as indicated on the relevant product page.
8.2 The production time reflects the nature of a craftsmanship carried out one piece at a time: the Maison will inform the Client when the Creation is shipped and will provide tracking references at the time of dispatch.
8.3 The delivery conditions, insured shipping and the regime applicable to destinations are set out in the Shipping Policy, which forms an integral part of these Terms.
8.4 Should the indicated production time be significantly exceeded, the Maison will inform the Client, communicating the new expected timeframe. The rights afforded to Consumers by applicable law in the event of late delivery remain unaffected.
8.5 The risk of loss of or damage to the Creation passes to the Consumer at the moment when the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the Creation. Every shipment is insured until delivery, as provided in the Shipping Policy.
Article 9 — Destinations
9.1 The Maison ships worldwide, under the conditions set out in the Shipping Policy in force at the time of the order, which distinguishes destinations with duties and taxes included from all other destinations.
9.2 For any enquiry concerning a specific destination — including the applicable import charges — the Client may contact the Maison before ordering: we will be glad to provide the information available.
Article 10 — Right of withdrawal (Consumers in the European Union)
10.1 Pursuant to Article 59(c) of the Italian Consumer Code (implementing Directive 2011/83/EU), the right of withdrawal is excluded for contracts for the supply of goods made to the consumer's specifications or clearly personalised.
10.2 Each Creation is produced individually, upon the Client's order, in the configuration and size selected by the Client and, where requested, with a personal engraving. The Client is informed of this before purchase, on each product page and at checkout. Accordingly, the right of withdrawal is excluded for Creations made to order within the meaning of Article 4; the exclusion is confirmed in the order confirmation email.
10.3 Earrings. Earrings, too, are made individually upon the Client's order, in the configuration of metal and gemstones selected by the Client and, where requested, with a personal engraving; as they are not held in stock, they are produced exclusively following the order. The exclusion of the right of withdrawal under Article 10.2 therefore applies to this category as well. Where the order includes a personal engraving, the Creation is clearly personalised for all purposes of Article 59(c) of the Italian Consumer Code.
10.4 Nothing in this Article limits the rights of Consumers arising from the legal guarantee of conformity (Article 12).
Article 11 — International orders (outside the European Union)
11.1 All sales of Creations made to order are final ("all sales are final on made-to-order pieces"). Since each Creation is produced individually upon the Client's order, orders cannot be cancelled by the Client and Creations cannot be returned, subject to any mandatory rules applicable to the Client. The Maison's right of cancellation in the sole cases provided for in Articles 5.4 and 5.5 remains unaffected.
11.2 Article 13 (care and assistance) applies to all Clients, wherever resident.
Article 12 — Legal guarantee of conformity
12.1 Consumers benefit from the legal guarantee of conformity provided for by Articles 128 et seq. of the Italian Consumer Code, within the terms and limits established by the legislation in force.
12.2 To report an alleged lack of conformity, the Client may contact the Maison at info@torrini1369.com or +39 055 2302401, indicating the order number and attaching photographic documentation. The Maison will examine the Creation and, where a lack of conformity is established, will apply the remedies provided by law.
12.3 The slight artisanal variations and the natural characteristics of the gemstones described in Article 4.5, disclosed before purchase, do not constitute a lack of conformity. The legal guarantee likewise does not cover normal wear, accidental damage, or damage resulting from improper use or from work carried out by third parties.
12.4 Purchases governed by Article 15 (professional Clients) are subject to the guarantee regime of the Italian Civil Code (Articles 1490 et seq.).
Article 13 — Care and assistance
13.1 Each Creation is accompanied by the Torrini 1369 Certificate of Origin, which documents its configuration and its making by the Maison. The Certificate is not an appraisal and does not constitute a valuation of the economic worth of the Creation.
13.2 Each Creation is made in the size indicated by the Client at the time of the order and, owing to the nature of its craftsmanship, does not allow subsequent alterations of its size. For this reason, the Client is invited to verify the size or length with the utmost care before ordering, making use of the size guide and the pre-purchase advisory service referred to in Article 4.3. Should the size received prove unsuitable, the Maison remains at the Client's disposal to consider, on a case-by-case basis, the possible solutions — such as an exchange or an atelier credit — which remain at the Maison's discretion and do not constitute a contractual obligation.
13.3 The Maison remains at the Client's disposal over time for the care of the Creation — professional cleaning, inspection of the prongs and of the stones — as part of its after-sales assistance.
Article 14 — Intellectual property
14.1 The Torrini 1369 name and trademark, and the content, photographs, texts and designs published on the Site, are the exclusive property of the Maison or of its licensors and may not be reproduced or used without prior written authorisation. Further provisions are contained in the Site's Terms of Use.
Article 15 — Professional Clients
15.1 Purchases made in the course of a trade, business, craft or profession are governed by these Terms insofar as compatible and, for all matters reserved for Consumers (including withdrawal and the legal guarantee of conformity), by the Italian Civil Code.
Article 16 — Personal data
16.1 Personal data are processed in accordance with the Privacy Policy published on the Site, which forms an integral part of these Terms to the extent of its subject matter.
Article 17 — Governing law, jurisdiction and dispute resolution
17.1 These Terms are governed by Italian law, without prejudice to any more favourable mandatory provisions applicable to the Consumer under the law of the country of the Consumer's habitual residence.
17.2 For disputes with Consumers resident in Italy, the courts of the place of residence or domicile of the Consumer shall have jurisdiction. For any other dispute, the courts of Florence shall have exclusive jurisdiction.
17.3 In the event of a dispute, the Consumer may have recourse to the alternative dispute resolution (ADR) procedures provided for by the legislation in force. Information on the competent bodies is available by contacting the Maison at info@torrini1369.com.
17.4 The invalidity or ineffectiveness of any individual clause of these Terms shall not affect the validity of the remaining clauses, which shall remain fully effective.
Article 18 — Amendments and versions
18.1 The Maison may amend these Terms at any time. Each order is governed by the version of the Terms in force and published on the Site on the date of the order. Each published version bears a version number and date; previous versions are archived by the Maison together with their period of validity.
