Cancellation, Withdrawal and Returns Policy

Versione italianaThis Returns Policy summarizes, in an accessible form, the provisions of Articles 5.7, 10, 11, 12 and 13 of the Terms and Conditions of Sale of torrini1369.com, which prevail in the event of any discrepancy. Capitalized terms have the meaning given to them in the Terms.
1. Made-to-order Creations
No Torrini Creation is held in stock for sale through the Site, and any pieces that may be present in the boutique are not intended for online sale: Creations are non-prefabricated goods, produced on the basis of the Customer's individual choice. Each piece of jewelry is made individually after the order, by the Maison's Florentine workshop, in the model chosen by the Customer, with the gemstone that characterizes it, and in the metal selected by the Customer — from the configurations offered or according to a configuration agreed before the order — and, for all categories except earrings, in the size indicated by the Customer, with a personal engraving where requested. Once made, the Creation is expressly destined for the Customer who ordered it: the cancellation and returns regime below reflects this nature.
2. Cancellation within 48 hours
The Customer may cancel the order, without giving any reason, within 48 hours of the Order Confirmation — for orders paid by bank transfer, sent upon receipt of the funds — by writing to info@torrini1369.com and quoting the order number. The amount paid is refunded by the same means of payment within 14 days of receipt of the notice, net of the costs actually incurred by the Maison to receive and return the payment, which are indicated in the Order Confirmation and in any event do not exceed: 5% of the amount for payments by card or PayPal; €100 for bank transfers from accounts outside the SEPA area. Bank transfers from accounts within the SEPA area are refunded in full.
Within the same period the Customer may request in writing a change to the specifications of the order, for instance to the engraving text; where the Maison confirms it, the 48 hours run anew from the written confirmation of the final specifications.
Upon expiry of the 48 hours, dedicated production begins and the order becomes final. This option is granted by the Maison to all Customers, wherever resident, on a contractual basis; it neither constitutes nor replaces the right of withdrawal provided for distance contracts, referred to in section 3.
3. Consumers resident in the European Union, the European Economic Area and the United Kingdom: right of withdrawal
Pursuant to Article 59(c) of the Italian Consumer Code (implementing Directive 2011/83/EU) and the corresponding provisions in force in the European Economic Area and the United Kingdom, the fourteen-day right of withdrawal provided for distance contracts does not apply to goods made to the consumer's specifications or clearly personalized.
Torrini Creations — non-prefabricated goods, made to order in the configuration chosen or agreed and in the size indicated by the Customer — fall within this category, earrings included. The Customer is so informed before purchase, on each product page and in the cart, by means of the mandatory confirmation of acceptance of the Terms, and the exclusion is recalled in the Order Confirmation.
The option to cancel within 48 hours (section 2) and the statutory guarantee of conformity (section 6) remain unaffected.
4. All other destinations
For Customers resident outside the territories referred to in section 3, all sales of made-to-order Creations are final ("all sales are final on made-to-order pieces"), without prejudice to the option to cancel within 48 hours under section 2. After that period, orders cannot be canceled and Creations cannot be returned, subject only to any mandatory rules that may apply in the Customer's country of residence.
5. Size
Each Creation is made in the size indicated by the Customer at the time of the order, which constitutes a production specification. The Maison does not guarantee that the size can be modified after the Creation has been made: many Creations, by the nature of their workmanship, do not allow it and, where technically possible, the modification is limited. The Customer is invited to check the size carefully before ordering, using the size guide and the Maison's pre-purchase consultation (info@torrini1369.com); sizes not listed may be requested by email before ordering.
Should the size received prove unsuitable, the Maison is at the Customer's disposal to help: any size adjustments, where technically feasible, are assessed case by case, at the Maison's discretion, on the conditions communicated to the Customer before the work is carried out, and do not constitute a contractual obligation (Terms, Article 13.2). The costs of insured shipping, both outbound and return, and any duties and import taxes relating to sending the Creation for adjustment and to its return are borne exclusively by the Customer, who is informed of them before shipping. The foregoing does not apply where the Creation was not made in the size indicated at the time of the order, in which case the statutory guarantee of conformity applies (section 6).
6. Lack of conformity
Nothing above limits in any way the statutory guarantee of conformity (Terms, Article 12).
To report an alleged defect, the Customer writes to info@torrini1369.com quoting the order number and attaching photographic documentation. The Maison examines the photographs and, where the defect appears plausible, arranges collection by insured shipping at its own expense; having examined the Creation, where the lack of conformity is established, it applies the remedies provided by law. If the examination of the Creation reveals no lack of conformity, the costs of collection and return remain at the Customer's expense, of which the Customer is informed before collection. The outcome of the examination is communicated to the Customer in writing, with the relevant reasons; it does not prejudice the rights granted to the Consumer by law and, in the event of disagreement, the Customer may have recourse to the procedures referred to in Article 17 of the Terms. For Business Customers (Terms, Article 15) the shipping costs are borne by the Customer.
The slight artisanal variations and the natural characteristics of gemstones, disclosed before purchase (Terms, Article 4.5), do not constitute a lack of conformity; the statutory guarantee does not cover normal wear, accidental damage, improper use or work carried out by third parties.
7. Damage on delivery
Should the package show any irregularity at the time of delivery, the Customer is invited to report it to the carrier and to contact the Maison promptly at info@torrini1369.com (Shipping Policy, section 6). Every shipment is insured until delivery.
