1. Subject matter and acceptance

1.1 These Terms of Use govern access to the website torrini1369.com (the "Site") and its use by users. By browsing the Site, the user accepts these Terms of Use; those who do not wish to accept them are invited not to use the Site.

1.2 Purchases made through the Site are governed by the Terms and Conditions of Sale, which prevail over these Terms of Use with regard to sales. The processing of personal data is described in the Privacy Policy and in the Cookie Policy.

1.3 The Site and its services are intended exclusively for persons of legal age, as stated in the Privacy Policy (section 15).

2. The Site operator

2.1 The Site is operated by Torrini 1369 s.r.l., with registered office at Piazza del Duomo 12/R, 50122 Florence, Italy — VAT No. IT 06111170483, Florence Companies Register (REA FI-601401), share capital €10,000.00, fully paid up, certified email (PEC) torrini1369@pec.it, email info@torrini1369.com, telephone +39 055 2302401 (the "Maison"). 3. Intellectual property

3.1 The Torrini name and registered trademark — the name, the shield and the historic logo — the designs and models of the Creations, the photographs, videos, texts, graphics and any other content published on the Site are the exclusive property of the Maison or its licensors and are protected by intellectual and industrial property laws.

3.2 No content of the Site may be reproduced, copied, modified, distributed, published or used, in whole or in part, for purposes other than personal consultation, without the prior written authorization of the Maison. In particular, the reproduction of the photographs and designs of the Creations and the making of jewelry reproducing their design are prohibited.

3.3 The user may consult the Site and print or save individual pages for personal, non-commercial use, keeping the proprietary notices intact.

4. Permitted use

4.1 The user undertakes to use the Site lawfully and properly, and in particular not to: (a) interfere with the operation of the Site or access it by unauthorized automated means (bots, scraping); (b) enter false information, or third-party data without authority, in the forms, in the chat or in communications with the Maison; (c) use the content of the Site for commercial or competitive purposes; (d) attempt to circumvent the Site's security measures.

4.2 The Maison reserves the right to restrict or terminate access to the Site for users who use it in breach of these Terms of Use, without prejudice to any other remedy.

5. Customer account

5.1 The user may create a customer account to manage their details, view their orders and save their preferences (wishlist). The user is responsible for access to their account and for the activities carried out through it, and undertakes to keep the credentials or access codes received with care; in the event of unauthorized use, the user is invited to inform the Maison promptly.

5.2 The user may request the closure of their account at any time by writing to info@torrini1369.com; data are retained as provided in the Privacy Policy.

5.3 The Maison may suspend or close an account used in breach of these Terms of Use, without prejudice to orders already confirmed.

6. Site content

6.1 The Maison takes care to ensure the accuracy of the Site's content and updates its information regularly. The images of the Creations illustrate a sample of the selected configuration: each Creation is handmade and set with natural gemstones, and the finished piece may show slight variations, as stated in the Terms and Conditions of Sale (Article 4.5). Prices and terms of sale are those indicated in the Terms and Conditions of Sale in force at the time of the order.

6.2 The Maison may modify, suspend or remove at any time content, features or Creations presented on the Site, without incurring any obligation toward users, without prejudice to orders already confirmed.

6.3 The Maison endeavors to ensure the continuity of the Site but does not guarantee that access will be uninterrupted or error-free: maintenance, updates or technical causes beyond the Maison's control may temporarily limit its availability.

7. Links to third-party sites

7.1 The Site may contain links to third-party sites or services (maps, social media platforms, payment services). The Maison does not control such sites and is not responsible for their content, their operation or the processing of data that takes place on them, which is governed by their respective notices.

8. Communications with the Maison

8.1 Communications through the Site's forms, live chat, email, WhatsApp or telephone are handled in accordance with the Privacy Policy. Conversations in which the specifications of a Creation are agreed are retained together with the order documentation, as stated in the Terms and Conditions of Sale and in the Privacy Policy (section 8).

9. Liability

9.1 To the extent permitted by law, the Maison is not liable for damage arising from the use of the Site, from the inability to access it, from third-party content or from viruses or other harmful elements not attributable to the Maison. Nothing in these Terms of Use excludes or limits the Maison's liability for willful misconduct or gross negligence, or the rights granted to consumers by applicable law.

10. Governing law and jurisdiction

10.1 These Terms of Use are governed by Italian law, without prejudice to any more favorable mandatory provisions applicable to the consumer under the law of the consumer's country of habitual residence.

10.2 For disputes with consumers resident in Italy, the courts of the place where the consumer resides or is domiciled have jurisdiction. For disputes with consumers resident in another Member State of the European Union, in the European Economic Area, in Switzerland or in the United Kingdom, the mandatory rules on jurisdiction under the applicable law remain unaffected. For any other dispute, the courts of Florence, Italy, have exclusive jurisdiction, subject to any mandatory rules that may apply.

11. Amendments and language

11.1 The Maison may amend these Terms of Use at any time; the version in force is the one published on the Site, bearing the version number and date. These Terms of Use are drawn up in Italian; the English version is a translation thereof and, in the event of any discrepancy, the Italian version shall prevail.

1. Oggetto e accettazione

1.1 I presenti Termini d'Uso disciplinano l'accesso al sito torrini1369.com (il "Sito") e il suo utilizzo da parte degli utenti. Navigando sul Sito l'utente accetta i presenti Termini d'Uso; chi non intende accettarli è invitato a non utilizzare il Sito.

1.2 Gli acquisti effettuati tramite il Sito sono disciplinati dai Termini e Condizioni di Vendita, che prevalgono sui presenti Termini d'Uso per quanto attiene alla vendita. Il trattamento dei dati personali è descritto nella Privacy Policy e nella Cookie Policy.

1.3 Il Sito e i suoi servizi si rivolgono esclusivamente a persone maggiorenni, come indicato nella Privacy Policy (sez. 15).

2. Il gestore del Sito

3. Proprietà intellettuale

3.1 Il nome e il marchio registrato Torrini — il nome, lo scudetto e il logo storico —, i disegni e i modelli delle Creazioni, le fotografie, i video, i testi, la grafica e ogni altro contenuto pubblicato sul Sito sono di proprietà esclusiva della Maison o dei suoi licenzianti e sono protetti dalle norme sulla proprietà intellettuale e industriale.

3.2 Nessun contenuto del Sito può essere riprodotto, copiato, modificato, distribuito, pubblicato o utilizzato, in tutto o in parte, per finalità diverse dalla consultazione personale, senza la preventiva autorizzazione scritta della Maison. È in particolare vietata la riproduzione delle fotografie e dei disegni delle Creazioni e la realizzazione di gioielli che ne riproducano il design.

3.3 L'utente può consultare il Sito e stampare o salvare singole pagine per uso personale e non commerciale, mantenendo intatte le indicazioni di proprietà.

4. Uso consentito

4.1 L'utente si impegna a utilizzare il Sito in modo lecito e corretto, e in particolare a non: (a) interferire con il funzionamento del Sito o accedervi con mezzi automatici (bot, scraping) non autorizzati; (b) inserire nei moduli, nella chat o nelle comunicazioni con la Maison informazioni false o dati di terzi senza averne titolo; (c) utilizzare i contenuti del Sito per finalità commerciali o concorrenziali; (d) tentare di aggirare le misure di sicurezza del Sito.

4.2 La Maison si riserva di limitare o interrompere l'accesso al Sito agli utenti che ne facciano un uso contrario ai presenti Termini d'Uso, fatta salva ogni altra tutela.

5. Account cliente

5.1 L'utente può creare un account cliente per gestire i propri dati, consultare i propri ordini e salvare le proprie preferenze (wishlist). L'utente è responsabile dell'accesso al proprio account e delle attività svolte tramite esso, e si impegna a custodire con cura le credenziali o i codici di accesso ricevuti; in caso di uso non autorizzato, è invitato a informare tempestivamente la Maison.

5.2 L'utente può chiedere in qualsiasi momento la chiusura del proprio account scrivendo a info@torrini1369.com; i dati sono conservati secondo quanto previsto dalla Privacy Policy.

5.3 La Maison può sospendere o chiudere un account utilizzato in violazione dei presenti Termini d'Uso, fatti salvi gli ordini già confermati.

6. Contenuti del Sito

6.1 La Maison cura con attenzione l'accuratezza dei contenuti del Sito e ne aggiorna le informazioni con regolarità. Le immagini delle Creazioni illustrano un campione della configurazione selezionata: ogni Creazione è realizzata a mano e con gemme naturali, e l'esemplare finito può presentare lievi variazioni, come indicato nei Termini e Condizioni di Vendita (art. 4.5). I prezzi e le condizioni di vendita sono quelli indicati nei Termini e Condizioni di Vendita in vigore al momento dell'ordine.

6.2 La Maison può modificare, sospendere o rimuovere in qualsiasi momento contenuti, funzionalità o Creazioni presentate sul Sito, senza che ciò comporti obblighi verso gli utenti, fatti salvi gli ordini già confermati.

6.3 La Maison si adopera per garantire la continuità del Sito, ma non garantisce che l'accesso sia ininterrotto o privo di errori: interventi di manutenzione, aggiornamenti o cause tecniche indipendenti dalla Maison possono limitarne temporaneamente la disponibilità.

7. Collegamenti a siti terzi

7.1 Il Sito può contenere collegamenti a siti o servizi di terzi (mappe, piattaforme social, servizi di pagamento). La Maison non controlla tali siti e non risponde dei loro contenuti, del loro funzionamento o del trattamento dei dati che vi avviene, disciplinato dalle rispettive informative.

8. Comunicazioni con la Maison

8.1 Le comunicazioni tramite i moduli del Sito, la live chat, l'email, WhatsApp o il telefono sono trattate secondo la Privacy Policy. Le conversazioni in cui vengono concordate specifiche di una Creazione sono conservate unitamente alla documentazione dell'ordine, come indicato nei Termini e Condizioni di Vendita e nella Privacy Policy (sez. 8).

9. Responsabilità

9.1 Nei limiti consentiti dalla legge, la Maison non risponde dei danni derivanti dall'uso del Sito, dall'impossibilità di accedervi, da contenuti di terzi o da virus o altri elementi dannosi non imputabili alla Maison. Nulla nei presenti Termini d'Uso esclude o limita la responsabilità della Maison per dolo o colpa grave, né i diritti riconosciuti ai consumatori dalla normativa applicabile.

10. Legge applicabile e foro competente

10.1 I presenti Termini d'Uso sono regolati dalla legge italiana, fatte salve le eventuali disposizioni imperative più favorevoli applicabili al consumatore in base alla legge del paese di residenza abituale del consumatore.

10.2 Per le controversie con consumatori residenti in Italia è competente il foro del luogo di residenza o di domicilio del consumatore. Per le controversie con consumatori residenti in un altro Stato dell'Unione Europea, nello Spazio Economico Europeo, in Svizzera o nel Regno Unito restano ferme le norme inderogabili sulla competenza giurisdizionale previste dalla legge applicabile. Per ogni altra controversia è competente in via esclusiva il foro di Firenze, nei limiti delle eventuali norme inderogabili applicabili.

11. Modifiche e lingua

11.1 La Maison può modificare i presenti Termini d'Uso in qualsiasi momento; la versione in vigore è quella pubblicata sul Sito, con numero di versione e data. I Termini d'Uso sono redatti in lingua italiana; la versione inglese ne costituisce traduzione e, in caso di divergenza, prevale la versione italiana.
